1 Travel Insurance;

Mountain Planner Adventure strongly encourage you to ensure you are covered by comprehensive travel insurance. And a proof or copy of travel insurance is mandatory before start trip. You should have travel insurance with a minimum emergency medical evacuation and repatriation coverage of US$200,000 covering all applicable dates of travel. This insurance should cover personal injury, emergency medical expenses, and repatriation costs, loss of effects and all other expenses which might arise as a result of loss, damage, accident, delay, cancellation or inconvenience, or the inability to join your trip for any reason. You acknowledge that insurance coverage is not included in the cost of any trip offered by Mountain Planner Adventure and you are required to obtain separate coverage at an additional cost. We suggest you to check your insurance policy and ensure that they will cover all costs upfront in the event of an evacuation. You agree it is your sole responsibility to ensure your travel insurance cover is adequate for your circumstances. Our team will help you in obtaining any documentation requested by your insurance company. 

2 General Booking Terms;

Please read carefully booking terms & conditions before you booking the trip with us! 

By booking a trip you acknowledge that you read, understand and agree to be bound by terms and condition. Completing the booking form and accepting the following booking conditions, you are agreeing to these conditions on behalf yourself and all other person or persons named on booking and represent that you are authorized to accept this terms and condition on their behalf. Everyone named on booking, or only one person is named, is hereafter referred to as “you”. Now we agree to operate the trip or trips booked by you.

We like to be very open and transparent about to expect when you book a trip with us, but if you like to know in details you will find here. And if you still can’t find what you are looking for, reach us by call or email we will assist further your inquiries. 

3 How to Book;

You may check availability through our website or by calling or emailing our reservations team to enquire about the specific trip you are interested in. We will respond and advise of availability, or you may book directly thorough our website. Reservations are subject to availability at the time of booking.

Once we have assured you of availability, to confirm your booking we require per-person 30% percentage of the total trip cost nonrefundable deposit, and the remaining balance can be paid on your arrival in any major currency. You can pay via bank wire transfer, credit card, debit card, or direct deposit. We also require you to complete a booking form and send it through either at the time of making the booking and paying your deposit, or soon after to ensure we have all details required of you.

By making a booking, you agree and accept our terms and conditions, including the terms and conditions set out in this document.  If you are booking on behalf of another person, we rely on your authority to act on behalf of any other traveler (s) on the booking and that authority will bind all such traveler (s) to these terms and conditions.

All travelers travelling who are aged 18 or over must complete their own booking form.  For travelers aged less than 18, the booking form must be completed by a parent or legal guardian.

4 Booking on Behalf of Other Travelers; 

By booking on behalf of other traveler(s) you are considered to be the responsible contract person for every traveler(s) included on that booking. Means you are a responsible for making all payments due in connection with your trip booking, notifying us or your authorized travel agent if any changes or cancellations are required and keeping your team informed.

By booking on behalf of other traveler(s) you represent and confirm that you have obtained all require consents. You are responsible for verifying that any information you provide on behalf of other traveler(s) is accurate complete and we will not under circumstances be liable for any errors in the information provide to complete booking.

5 Late/Last Minute Booking; 

We accept the late/last minute bookings within 72 hours prior to the trip departure. However late/last minute bookings may not be acceptable for travel to some restricted regions due to non-availability of flights and insufficient time to arrange the special travel permits. If you make a late/last minute bookings please wait our written confirmation of availability for further process related to the trip. if you made any arrangement or flight bookings without or before our written confirmation about the trip chosen, and the trip is not possible to run we will not liable for refunds and any of your loose.

6 Booking Contract;

Your booking is confirmed and a contract exists when we issue a written conformation after receipt of the applicable deposit amount. Please check your conformation carefully and report any incorrect or incomplete information to us or your authorized travel agent immediately. Please ensure the names are exactly as stated in the relevant passport or travel documents. You agree to provide full, complete and accurate information to us or your travel agent.

7 Payment Terms; 

All pricing is in USD dollar and inclusive of any GST! You can make the payment by bank wire transfer or card.

Note: Bank service charges related to submitting a deposit are the responsibility of the traveler(s)

7.2 Deposit;

Require a deposit 30% of your total trip cost before your arrival. The deposit is non-refundable but maybe transferable to the similar types of trips, in the case if you change to the other similar types of trips within 30 days prior to the schedule departure.

You can expect to receive an updated invoice from us within 24 to 72 hours of summiting an online payment. Your invoice confirmation will be sent once we verify that we received the funds. The online payment for the deposit is subjected to a 4% processing fee. 

7.3 Trip Balance;

The trip remaining balance and any other additional travel arrangement booked with us can be paid in any major currency on your arrival at Mountain Planner Adventure office. OR, can pay by debit/credit card with 13% chargeable to cover the transaction fee and local taxes.
You can expect to receive an updated invoice from us within 24 to 72 hours of summiting an online payment. Your invoice confirmation will be sent once we verify that we received the funds

8 Cancellations; 

8.1 Cancellation by You / Traveler(s); 

If you need to cancel your trip booking you can do that anytime, but please be informed that the 30% deposit is no-refundable. The deposit is considered as a trip cancellation fee. This policy is effectively applicable right after you confirmed your booking with us.
If you paid more than the trip deposit amount, we reduce 30% as a cancellation fee from your actual amount. We require your cancellation request in written to refund your remaining balance and will be refunded to you via original payment methods within one month.
If you are unable for any reason to start your trip this will be considered a cancellation by you.

8.2 Cancellation by Us; 

Very rarely when the minimum number of bookings required to run a trip is not met for specific region like restricted area, we may have to cancel the trip. Please enquirer at the time of your booking as to whether your trip is confirmed to depart.
We encourage you to do alternate trip, if your actual trip is cancelled due to not enough a number of traveler(s) to run a trip.

8.3 Domestic Flights Delays & Cancellations;

Domestic flight delays and cancellations are caused often during bad weather conditions in the mountain regions. Everest region (Lukla and Phaplu airport), Makalu region (Tumlingtar airport), Kanchenjunga / Taplejung (Suketar airport), Annapurna region (Jomsom airport), Dolpo region (Juphal airport), Mugu (Talcha airport) and Humla (Simikot airport). We advise you to keep some extra money for food and accommodation during the flight delays and cancellations. We are not liable for your extra expenses like if you wish to charter the chopper/helicopter or any of your expenses during the flight delays and cancellations. We will offer you to do alternate trip in same cost, if there are no possibilities to start the original/current trip.

8.4 Cancellation by Force Majeure; 

Force majeure is unusual and unforeseeable circumstances beyond our control, examples of which are: natural or nuclear disaster, war, riots, civil unrest, civil strife, terrorist activity, epidemic, industrial disputes airport closed, travel advisory or other similar events beyond our control. If this happened, we will work with you for similar alternate trip or to reschedule the trip date without extra cost.

If we have to cancel the trip before the date of departure due to Force Majeure you will be entitled to transfer to a future trip, or we can hold your trips payments as a credit towards a future booking. Our refund policy on deposit still effectively applies in these types of situations. We will encourage you to take travel insurance policy that will cover this type of trip interruption or cancellation.

We are not liable for your inconvenience due to any of the Force and Majeure.

9 Changes / Itineraries;

9.1 Changes by You / Traveler(s);

We understand that sometimes even the best-made plans need to change. We will do our best to accommodate any alteration, but are sometimes limited due to availability on trips and operational requirements. If you wish to change your booking or travel dates, please alert us as soon as possible. We will help you to reschedule your trip without extra charge but you are responsible for any increase in price between the time original booked and the new trip dates.

You are responsible for ensuring that you and your team information provided to us is accurate and up-to-date. Any changes to your name on any booking are subject to our booking approval condition. Any changes to a booking depend on availability and are subject our approval and these terms. Any extra costs incurred for making the change will be charged to you along with an administrative fee. Cancellation of any trip or service included in a booking will not be considered a change for purposes of this section and will be governed by the applicable cancellation terms. No changes are permitted to any booking within 2 weeks of the trip departure.

9.2 Postpone the Trip by You / Traveler(s);

If you or your team unable to travel on your schedule date and wish to postpone the trip. We require the written request within 2 weeks prior to trip departure. Somehow if you are unable to write us about postponing your trip, it is considered to a cancellation by you.

9.3 Changes by Us;

We priority the safety and well-being of all travelers when considering whether to change an itinerary. but the nature of our trips are outdoor activities, mean that itineraries are subjected to change inclement weather, safety concerns, health concerns, unforeseen circumstance, so we reserve the right to amend the itineraries before or during the trip. To amend or change the itineraries is not considered a cancel the trip.
You acknowledge that you must have reasonable financial resources to cover incidental expenses during travel with us, whether or not such expenses arise from a change of itineraries, and we are not liable for your lack of prepare adequately to travel and unforeseen circumstances which may arise during the travel. We are not liable for any indirect and consequently losses associated with any changes to bookings or itineraries.

10 Early Termination From / Incomplete the Trip; 

We are not liable for refunds if you or your team stopping a trip or finished the trip earlier than actual trip schedule due to health, personal, natural disaster or unforeseen reasons. Please do not hesitate to ask us if you have any questions about our policies.

11 Risk Acceptable; 

Our priority is safety of traveler(s) and trip crew(s). Our trips operate in the outdoors, and may include an inherent element of risk, along with potential exposure to dangers and hazards. Risks, dangers, and hazards. Those risks, dangers and hazards include, but are not limited to: changing weather conditions, physical and mental fatigue, flights cancellation or delays, acts or omissions of the public or other participants, political protests, war, accident, or illness in remote areas without the possibility of immediate evacuation or availability of medical suppliers or facilities, natural events such as earthquake, avalanche, or landslides, and accidents during travel on the trip, including travel in vehicles, and aircraft. Encountering these risks, dangers and hazards could result in physical or mental injuries, damage to personal property, or death. You understand and accept that you may encounter these and any other inherent risks, dangers, and hazards not specifically listed in this agreement at any time.

You acknowledge that adventures trips may involve a significant amount of risk to your health safety and you have considered any potential of risks. You hereby assume responsibility for all such risks and release us from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in

travel, including adventure travel specifically, and participating in adventurous activities such as those included in trip itineraries or offered by us. We require you to confirm assumption of this responsibility by completing the participation waiver prior to departing on your adventures trip.

You or your team will not be entitled to any refund for unused or missed services or costs incurred as a result of termination of your trip arrangements, including, return trip, accommodations, meals, and incidentals. We are not liable for any extra or increase cost due to circumstances. Highly we encourage you to do strong travel insurance to cover all the circumstances.

12 Health-Medical Information;

Medical forms are mandatory for adventures and certain trips, if you have any pre-existing medical conditions may impact your ability to participants for adventures and certain trips without facility of medical accessory. You and your team agree to disclose all relevant information and complete the medical form accurately. 
We reserve the right to request further necessary information about medical status for your health-safety and operation the trip. We are not liable for your inconveniences if you are unable to complete the requirement medical form and disclose to necessary information to us. 

We ensure you to consult with your physician to confirm your fitness level for participation in any planned activities. We will not provide medical advice, it’s your responsibility to assess the risk and requirements of each aspect of the trip based on your own circumstances. 

Travelling with us may involve visiting remotes regions, and where medical care may not be easily accessible and the medical facilities may not meet the standards of your home country. The conditions of medical facilities in the region you may visit on your trip varies and we may not representations and responsible in relation to the availability or standard of medical facilities in those regions.

We reserve the right to deny you permission to travel or participate in any aspect of a trip at any time and at your own risk and expense where we determine that your physical or mental condition renders you unfit for travel or you represent a harm to other travelers and danger to yourself.

13 First Aid; 

Our guides will have first aid kit with basic and potential necessary supplementary equipment. All our guides are well trained of the relevant first aid course. Guides have a duty to provide reasonable care to customers during the trip, which may include administering first aid in emergencies. However, we are not liable for specific medicines. the unlikely event that you require first aid while on the trip, you consent to your team leader, guide or any other person administering first aid to you and any fellow travelers traveling with you.
a) Consent: You consent for first aid treatment, and acknowledging that you understand and accept the nature of the care.
b) Limitation: You understand agree that guides are only able to provide the first aid, and they are not responsible for critical treatment.
c) Emergency Services: You should understand that first aid is not a substitute for professional medical care, and you may consent to further assistance from emergency services or healthcare professional.
d)Confidentiality: Any personal or medical information shared during the provision of first aid we will keep confidential and only will shared with necessary parties, such as emergency responders or medical personnel.
e) Release of Liability: You understand and agree to release us from liability for any injuries or damages, that you acknowledge the provision of first aid was in good care with faith.
f) Compliance Laws and Regulations: You acknowledge and agree to comply with relevant laws and regulations governing the provision of first aid with evidence or witness.
g) Indemnification: You agree and acknowledge to indemnify and harmless to provider of first aid against any claims or liabilities arising from your own actions or omissions.
h) Termination of Services: We may reserve the right to terminate first aid services if we feel the safety is at risk.

14 Special Request;

If you or your team have any special requests please disclosed to us at the time of booking. We will reasonably efforts to accommodate special request but may not always possibly given the nature of the destinations visited and availability of options outside a planned itinerary. Certain activities may be unreachable to you if your ability is sufficient in any way. If you have dietary requests you should disclosed to us in the time of your booking. During your travelling time with us we will care and advise any relevant suppliers of your requirements, but we cannot guarantee that such requests will be accommodate. We are not liable if such requests are not met or accommodate.

15 Nutrition / Foods During the Trip; 

The food menu is based on local and western cuisine and can choose any food item from the menu. But the food we priority to serve local homestyle, nutritious and healthy. We seek to support local producers and reduce import foodstuffs. If you have dietary allergies and special request please disclosed to us at the time of booking. 

15.1 Breakfast – Typically a continental spread of cereals, seasonal/local fruits and vegetables, Local Breads, Toast, Oats, Pancakes and tea, coffee always available.

15.2 Lunch – Dumpling/mo.mo made by local wheat, buckwheat breads, Dishes of potato etc., and Tea coffee.

15.3 Dinner – Soups, Rice, Curry, Potato etc. and tea.

15.4 Deserts – Seasonal fresh fruits, Puddings etc.

15.5 Snacks – Crackers, cookies, fruits, cheese for tea and coffee breaks.

16 Liability; 

You acknowledge and agree that to the fullest extent permitted by law and unless caused by the negligent or conduct of Mountain Planner Adventure, we will not be liable for any claims, actions, loss or damage arising out of personal injury or death, or property damage, loss of service including consequential, exemplary or punitive damages which may arise in connection with your participation in any trip. 

Additional risks may arise including, but not limited to, hazards of traveling in remotes and undeveloped areas, hazards of travel by bus, car, aircraft and other means, unforeseen, nature disaster, unrest, differing levels of sanitation, differing safety standards, risks associated with water, drinks, food, plants, insects and animals, diseases and transmission of disease to you or members of your family, accident or illness in areas of difficult evacuation or poor medical facilities, acts of governments, all occurring during the trip. You are voluntarily participating, knowing there are risks. You agree to accept any and all risks. You must agree and acknowledge to release Mountain Planner Adventure, our related companies and employees from to claim against any of known or unknown, arising from contracting during the traveling period. This release of liability, assumption of risk and agreement not to make a claim is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your heirs, legal representatives and assigns.

We will not be liable for any criminal conduct of any third party or breach of any law by any person with whom you travel on the trip.
You may not rely on any representations concerning the trip made by Mountain Planner Adventure which are not contained in these conditions.

17 Jurisdiction and Governing Law;

The contract and terms are subjected to the law of Nepal. And this agreements and rights and responsibilities of the parties will be construed and take effect in accordance with and be governed by the law of Nepal.

18 Complains; 

We give our best efforts to make an enjoyable and success your trip with us, however sometimes things may not go smooth due to certain circumstance. If you addressed any issues or complaints during the trip, please inform to your guide as quickly as possible, if still not solve in the current local spots, please do not hesitate to contact the Mountain Planner Adventure office as quickly as possibly by any accessory procedure. We will seek to resolve it so you can enjoy your trip.

19 Others;

19.1 Travel Documents; 

Travel document is required for traveling, and you must have a passport with 6 months validity dates with all the travel documents required by the governmental authorities including visas, permits and travel insurance policies. It is your sole responsibilities to obtain information and to have in your possession all the necessary travel documents and identification required for entry, departure and travel. We will not liable for any disruption to your travel plans or any associated costs incurred as a result if your failure to have the correct travel documents.

19.2 Visa; 

Most of passport holders can obtain a visa on arrival except Nigeria, Ghana, Zimbabwe, Swaziland, Cameroon, Somalia, Liberia, Ethiopia, Iraq, Syria, Afghanistan, and Palestine passport holders. But we encourage all clients to check the current conditions and protocols with Nepal immigration (https://nepaliport.immigration.gov.np). If you are failure to obtain the visa by your own personal issues, or any other reasons, your trip will be considered to cancel with us. We will not liable for your inconvenience to lose the trip with us and the trip deposit terms will effectively apply.

19.3 Delayed Luggage on Arrival;

We will not be responsible for any delay in the arrival of your luggage that affects your trip with us. But if you want to start your trip, we can help you get your luggage and make arrangements to get you on your trip. You must fill out an official form at the airport with permission for Mountain Planner Adventure teams to collect your lost or missing luggage on your behalf. After we receive your luggage, we will deliver to you following day by any possible auxiliary access. Extra cost will be applied but depends on your location on the trip. It is added on service to complete your trip smooth and successfully.
